In many cases, traumatic brain injury (TBI) is associated with personal injury litigation requiring rehabilitation professionals to serve as expert witnesses. Increasingly, speech-language pathologists have been called on to play this role. Because of the nature of communication impairment after TBI, the testimony of speech-language pathologists often overlaps with that of neuropsychologists. The purposes of this article are to describe critical aspects of personal injury litigation and expert testimony, describe communication deficits associated with cognitive and psychosocial impairment common after TBI, and promote a collaborative approach to assessment and preparation for legal testimony.
