Ij ..... 17 ... .,.23 ...... 25 ...... 27 SOTES ON THE SALE OF FOOD AND DRUGS ACTS.Prior to the year 1860, legislation against adulteration dealt with only a few articles of food, and was enforced iiiainly for the benefit of the Inland Revenue. It \\.as an offence at cominon law to adulterate food, but no provision was made for analysing samples, and action was seldom taken. In 1860, the '(Adultera-tion of Foods Act," to prohibit the sale of adulterated articles of food and drink, was passed ; it was extended to include drugs by an amending Act in 1872. These Acts, however, were repealed by the (( Sale of Food and Drugs Act;" 1875, which itself has been amended by further .4cts of 1879 and 1S99. Under these Acts, any suspected article of food or drug, which may be the subject of a prosecution, is required to be analysed by a Public Analyst, who must give a certificate of his analysis, and, every quaiter, furnish a report of his work under the Act to the Local Authority.In a court of law, certificates issued by a Public Analyst, whether acting for the prosecuting authority or for the defendant, are accepted as evidence of the facts stated therein, without the Analyst himself being present. In any case, however, the personal attendance of the Analyst inay be required by either side. Public Analysts are appointed under Section IC uf the "Sale of Food and Drugs Act," 1875, which is as follows :-'' Ap$oi?ifiiieiifj am? In the City of London and the liberties thereof the Commissioners of Sewers of the City of London and the lil>erlies thereof, and in all 4 other parts or the metropolis the vestries and districl boards acting in execution of tlie Act for the better local management of the nietro- polis, the court of quarter sessions of every county, and the lmvn council of every borough having a separate court of quar:er sessions, or having under any general or local .Ict of Parliainent or otherwise a separate police estaliliehment, may, as soon as convenient after the passing of this Act, where no appointment has been hitherto made, and in all cases as and when vacancies in the ofice occnr, or when required so to do by :he Local Government I:oard, shall, for their respective city, districts, counties, or boroughs, appoint one or more persons possessing competent Itnowledge, skill, and experience, as analysts of all articles of food and drugs sold within the said city.nietropolitan $,istricts, counties, or boroughs, and shall pay to such analysts siich remniieration as shall be inutually agreed upon, and may remove him or them as they shall deem proper ;but such appoiiitments and reinovals s1i:ill at all times be subject to tlie ap1xom1 of the Local Governwent Board, who may require satisfactory ponf of com-petency to be supplied to them, and niay give their approval absoliitely or with modifications as to the period of the nppointment ant1 removal, or otherwise : Provided that no person shall hereafter lie appointed an anal>-st for any place under this section who shall lie engaged directly or indirectly in any trade or biisiness connected with the sale of food or drugs in such place.In Scotland the like powers shall be conferred and the like duties shall lie imposed upon the cominissioners of supply at their ordinary meetings for comities, and the coininis- siiiners or boards of police, or where there are no such commissioners or boards, upon the town councils for boroughs within their se\-era1 jurisdictions ; provided :hat one of IIer hlajescy’s I’rincipal Secre- taries of State in Scotland shall lie sulistituted for the Local Govern- ment kard of England. In Ireland the like powers and duties shall he conferred and imposed respectively upon the grand jury of every county and to\vn council of every borough ;provided that the Local Government Board of Ireland shall be su1)stitntetl for the 1,ocal Govern-ment Board of England.” Since 1875 many changes have taken place in the constitu- tion of Local Authorities, largely owing to the creation of County and Borough Councils.The section quoted above was merely permissive, and many Local Authorities failed to appoint Analysts, or took very few samples.
