Reader Joe Dimeo writes with the following criticisms of AWWA's Manual M1 and “Base‐Extra Capacity Water Rate Design” (JOURNAL AWWA September 1983) by R.F. Banker: no rationale is given for allocating costs to base (commodity) or extra capacity (demand) and the considerable variation between the two systems; measuring extra capacity on an individual class basis is beyond the ability of almost every water district in the US; nothing tangible supports the assumption that extra capacity is contributed primarily by users in the first 15,000 gal/month category; though the manual recognizes the wide variation in water usage habits within each class and therefore the unavoidable discrimination in charges to individuals, it blandly dismisses this problem by saying that this issue is too complex to deal with; and the manual makes a weak case for assigning the balance of cost‐of‐service and unit costs on an individual basis in the actual design and development of water rates. R.F. Banker responds to each of Dimeo's points, and concludes that careful study of the new Water Rates Manual M1, including recognition of the intent and limitations of such a manual as set forth in the introduction, will provide the user with a basic understanding of the principles of rate‐making.

This exchange of views on construction management took place during the 1983 Annual Conference in Las Vegas on June 6, 1983. Panelists were: Donald J. Duck, vice president of Harza Engineering, 150 S. Wacker Drive, Chicago, Ill, who has had field experience with construction management; Richard S. Gabrielse, president of Midwest Mechanical Contractors, P.O. Box 19220, Detroit, Mich., a firm that specializes in construction of water and wastewater treatment plants; C.E. (Ed) Haltenhoff, now a member of the faculty of the civil engineering department of Michigan Technical University, Houghton, Mich., and formerly general manager and president of the design‐build firm of Elzinger&Volkers, Inc., of Holland, Mich.; and Robert J. Smith, a practicing attorney and civil engineer who specializes in construction law with the firm of Wickwire, Gavin&Gibbs, P.O. Box 1683, Madison,Wis. Glen H. Resolving construction disputes through means other than litigation is now recognized throughout the construction industry as a more expeditious, less costly, and less timeconsuming means of settlement. Arbitrators and mediators are professionals who are knowledgeable about construction practices, are trained by the American Arbitration Association, and are neutral. Parties to the dispute are assured that arbitrators or mediators understand the complexities of construction disagreements and can resolve the issues equitably.

Today's uncertain construction costs coupled with overly competitive bidding make cost overruns and claims by contractors in the heavy construction industry almost inevitable. Negotiating such claims, although time‐consuming, can be an equitable means of settlement. Each party's position must be documented from the beginning of the project before claims exist, and positions must be clearly defined when negotiations take place. All parties must be willing to compromise. Tactics that permit settlement by negotiation are described.

Mediation, based on voluntary submission of disputes to an impartial third party, is a viable alternative to litigation as a means of resolving conflicts in the construction industry. Mediation saves time and is cost‐effective when those involved are willing to compromise to arrive at an acceptable solution.

The slowdown in the economy and the pace of construction, the mushrooming of new technology, and greater competition have created new conditions under which construction contracts for the water industry operate. These factors have led to less harmonious relationships among the parties to a construction contract. The development and use of new products introduce additional potential pitfalls and further complicate the timely completion of a project.

Three types of serious contract disputes that commonly arise during the construction of water treatment facilities are related to schedule delays, site conditions, and performance of the contract. Typical provisions of construction specifications pertaining to such disputes are examined. Finally, four techniques for resolving disputes are discussed from the project owner's point of view.
