The frequency and severity of obstetric lawsuits make the perinatal area a risk management priority. Risk management deals with the probability that a given risk will result in an adverse outcome and attempts to mitigate the consequences of adverse events. Perinatal care providers cannot escape risk in their everyday work environment. The article explores perinatal risk issues and offers recommendations and risk management strategies that may help minimize perinatal liability in the antepartum, intrapartum, and postpartum areas

The perinatal nurse is charged with providing safe and effective care in both routine and emergency situations. This duty arises from the states' nurse practice acts and American Nurses Association's Code for Nurses, and it has been affirmed by a growing body of case law. Current changes in health care systems have created new challenges for the perinatal nurse. In some instances, the transformations occurring in health care may actually hinder the nurse's ability to provide care when faced with an obstetric emergency. These changes do not, however, alter the nurse's affirmative duty to take some positive action when complications arise. The article elaborates essential nursing actions required when an obstetric emergency occurs within the context of redesigned maternity settings

The growth of neonatal transport has led to the development of new legal implications for nursing practice. Nurses involved in transport must be well versed in the skills required for safe and effective transfer to defend successfully against claims of negligence. Transport nurses must also have a thorough knowledge of the scope of practice permitted in each state through which transport occurs and regulatory statutes related to neonatal transfer. A quality assurance and improvement program is an essential component of neonatal transport and can be an effective risk management strategy. The article delineates the legal consequences of neonatal transport and describes important elements in risk reduction for the transport team

The article presents an overview of the role and qualifications of the nurse expert in medical malpractice cases. The phases of involvement in the legal process, from review of medical records to testifying in deposition and at trial, are described. Essential information is presented about factors to consider in formulating an expert opinion and strategies for testifying in medical malpractice lawsuits.
