AbstarctIn the National Transportation Act of 1967, provision was made, by means of Part III of the legislation, for the federal government to regulate directly the extra‐provincial motor carrier industry. This section has never been implemented and this article attempts to explain why. Such an explanation, it is argued, is important because of the philosophy of the NTA, the responsibilities given to the Canadian Transport Commission and the inadequacies of the existing provincial regulatory systems.The explanation is to be found in an analysis of two factors whose interrelationship has been given inadequate attention. The first factor is the growing recognition of the need for intergovernmental collaboration in transportation planning and regulation. The second is the role of regulatory bodies in the policy process. The argument is advanced that the conflict over implementation of Part in illustrates a number of problems with respect to the appropriate functions of regulatory agencies, particularly in the context of intergovernmental negotiations. The article concludes with the suggestion for a possible course of action that may be applicable to other policy areas.Sommaire.La partie III de la Loi nationale sur les transports de 1967 prévoyait la régulation directe par le gouvernement fédéral de l'industrie du transport extre‐provincial par véhicule moteur. Abstract.Based on a questionnaire mailed to the foreign service officers in the Canadian Department of External Affairs, this article examines diplomats' motivations for entering the foreign service and their perceptions of the advantages and disadvantages of a diplomatic career. Officers are differentiated in the study by sex, place of origin, primary official language, length of service and perceptions of themselves as generaûsts or specialists. It was found that the nature of the work of a diplomat rather than the benefits of the work environment were more important to officers both in terms of reasons for choosing a foreign service career and in terms of rewards of diplomatic life, while the work environment was heavily emphasized when officers examined the disadvantages of the foreign service. Significant differences in officers' attitudes emerged particularly when they were analysed on the basis of their primary official language and length of service in the department. Among the most interesting findings were the relative unimportance of service to Canada and international humanitarian considerations as factors motivating officers to join the department and as rewards of the service, the lower level of job satisfaction among generalists than those with at least some degree of specialization, and the apparently lower degree of career satisfaction among diplomats recruited since 1960 compared to those who had joined the department earlier.Sommaire.Sur la base d'un questionnaire envoyé aux représentants à l'étranger du Ministère canadien des affaires étrangères, l'auteur de cet article examine les raisons qui ont fait choisir cette carrière aux diplomates et les avantages et inconvénients qu'elle présente à leur avis. Cette étude examine les diplomates d'après leur sexe, leur lieu d'origine, leur langue, la durée de leur service et le fait qu'ils se considèrent comrne des généralistes ou des spécialistes. L'auteur conclut que c'est la nature du travail plutót que les avantages du milieu de travail qui est importante pour les représentants à l'étranger, aussi bien du point de vue de leur choix de cette carrière que de celui des satisfactions offertes par la vie de diplomate Par contre, ils insistent beaucoup sur le milieu du travail lorsqu'ils parlent des désavantages de la carrière. L'analyse sur la base de la langue officielle maternelle et de la durée de service a dégagé des differences d'attitude significatives. Abstract.This paper explores the effects that minority government has upon the work of the senior civil servant. Most of the material is drawn from the Canadian federal scene but the conclusions are believed to be applicable to most political systems based on the principle of responsible government. The paper is concerned with the position of scrupulously non‐partisan officials whose duties require them to offer policy advice or to manage sizable organizations.Generalization about minority governments is difficult because many different scenarios are possible. However, where the government perceives itself as relatively secure, the official life of a senior civil servant is likely to be more or less normal. Where the government is a doomed minority, the official is likely to face a number of pressures and uncertainties.The intermediate minority scenario is of the greatest interest. At such times an official's policy proposals are especially likely to be judged in a tactical context rather than on their intrinsic merit. Because of delays in the decision‐making or legislative processes, he may be required to operate a program without benefit of a policy decision. The budgeting of necessary but humdrum items becomes a special problem. Uncertainty affects the whole policy and administrative area in which he works.There is little ground for the belief that the bureaucrats are necessarily stronger when the political regime is weaker, but certainly their life is more harried than in more normal times.Sommaire.Le présent article étudie l'influence que l'avènement d'un gouvernement minoritaire peut avoir sur la tâche des fonctionnaires supérieurs. A cette fin, nous nous sommes inspirés de la scène fédérale canadienne mais nous croyons que nos conclusions peuvent s'appliquer à tout système politique régi par le principe de la responsabilité ministèrielle. L'article étudie k situation de fonctionnaires scrupuleusement non partisans qui doivent, de par leurs functions, donner des conseils quant aux politiques àétablir ou qui doivent diriger de grandes organisations.II est difficile de généraliser à propos du gouvernement minoritaire puisque différentes situations peuvent se présenter. Bien sûr, lorsqu'un gouvernement se sent relativement sûr, la vie professionnelle du fonctionnaire supérieur se déroulera vraisemblablement de façon normale. Lorsqu'un gouvernement est minoritaire et vouéà la défaite, le fonctionnaire devra subir de nombreuses pressions et affronter de multiples incertitudes.La situation d'un gouvernement minoritaire se situant entre ces deux extrêmesest des plus intéressantes. Dans un tel cas, les mesures que proposera le fonctionnaire ont de fortes chances d'être évaluées sur un plan tactique plutôt que d'etre jugées au mérite. Par suite de retards apportés au processus de prise de décision ou au processus législatif, le fonctionnaire peut être obligé de mettre en application un programme sans bénéficier d'une décision de principe. La budgétisation d'articles nécessaires mais banaux devient un problème particulier. Abstract.This paper assumes that Planning‐Programming‐Budgeting (ppb) is preferable to the current historical budgeting procedure of municipalities. This is in part becauseppbnecessitates policy‐making (defined as the setting of goals). The paper argues that the ability of municipalities to adoptppband policy‐making is severely constrained by fiscal imbalance. The reliance of Canadian municipalities on conditional transfers and on the property tax has negatedppbprocedures by distorting priorities and narrowing decision‐making. The paper further argues that inflation will accentuate the financial problems of municipalities because of different revenue and tax elasticities.The point of departure is a brief examination of the logic behind urban government and the division of responsibilities. The second section looks at municipal fiscal imbalance, and the third analyses how fiscal imbalance negates policy‐making andppb. A final section suggests three remedies that might induce adoption ofppb. One would reduce the distortions of transfers and the other two would ease fiscal imbalance.Sommaire.Cet article suggère que le processus de Planification‐Programmation et Budgétisation (ppb) est préférable au processus de budgétisation couramment en usage dans les municipalités, en partie parce que leppbimplique la détermination d'objectifs politiques. L'article soutient que la possibilité d'adoption duppbet d'une politique précise par les municipalités est très limitée à cause du déséquilibre fiscal. Abstract.While it has been generally known that the development of the cabinet secretariat in Canada within the Privy Council Office was strongly influenced by the British model, the nature of this influence has been obscure. Documents in the King Papers reveal not only that a study of the British organization was undertaken for Mackenzie King by Burgon Bickersteth, then warden of Hart House, in 1927, but also that the Prime Minister later discussed the question with the Governor General, Lord Tweedsmuir, in 1935. The probable effect of the proposals made at that time on Mackenzie King's ultimate decision are examined, and thereby provide an illustration of his method of reaching decisions.Sommaire.On reconnait généralement la forte influence du modèle britannique sur le développement du secretariat du cabinet dans le cadre du Conseil privé, mais on connait mal la nature de cette influence. Des documents trouvés parmi les papiers de Mackenzie King révèlent qu'en 1927, Burgon Bickersteth, qui était alors le directeur de Hart House, avait entrepris une étude du système britannique pour le compte du Premier Ministre, qui en avait discuté plus tard, en 1935, avec le Gouverneur Général, Lord Tweedsmuir. Abstract.At present in Canada we are facing an era of increasing change, not only of the institutions and systems within our society, but in the values of both individuals and groups in society itself. These changes are perhaps nowhere more apparent than in the increasing crises and problems in the administration of justice in Canada. Given the many impacts of technology, increased communication and urbanization, the future of the society, of crime, and of the administration of justice are extremely uncertain. As discussed in the paper, in responding to this uncertainty those guiding the criminal justice system have a triple responsibility: to the public, to the offenders, and to the staff of the system itself. However, as I suggest, there are some major difficulties in carrying out these responsibilities.The paper then reviews the past application of social science to crime and delinquency policy in Canada. As I suggest, the contribution of social scientific research to the administration of justice has been minimal, probably because of limited resources and a lack of good information and statistics. Even if these problems were not present, there are other important problems facing the application of social science to this policy area in the future. The paper describes problems as the negative result, which seems to dominate social scientific results and does not encourage administrators to return for more advice, since typically the advice is either, we don't know, or the way we have been proceeding is wrong. The paper concludes by suggesting some alternatives for improving the interface between social science and social policy in the future.Sommaire.A l'heure actuelle nous traversons au Canada une ère de changement croissant, non seulement dans les institutions et les systèmes au sera de notre société, mais aussi dans les valeurs fondamentales des individus et des groupes. Ces crises et changements croissants se manifestent peut‐être davantage dans l'administration de la justice que dans toute autre activité au pays. Vu les nombreuses influences de la technologic, des communications accrues et de l'urbanisation, l'avenir de la société, de la criminalité, et de la justice sont extrêmement incertains. Les personnes chargées de guider le système de justice pénale ont, comme en discute mon exposé, une triple responsabilité: envers le public, envers les délinquants et envers le personnel du système lui‐même. Toutefois, certaines difficultés majeures entravent l'exercice de ces responsabilités.Dans le même exposé, j'examine ensuite l'application des sciences humaines aux politiques concernant la criminalité et la délinquance au Canada. J'ai trouvé plutôt minime la contribution que la recherche en sciences humaines a apportée à l'administration de la justice, à cause peut‐être de ressources limitées et de manque de bonnes données et de statistiques. Même si les problèmes susmentionnés étaient absents, il existe néanmoins d'autres problèmes importants que devra surmonter à 1'avenir l'application des sciences humaines aux politiques concernant la criminalité et la délinquance. Les problèmes sont décrits dans mon exposé comme étant le résultat négatif qui parait caractériser la recherche en sciences humaines et qui décourage les administrateurs à solliciter d'autres conseils, vu que typiquement ont leur répond: ‘nous ne savons pas’ ou bien ‘la voie suivie jusqu'ici est mauvaise.’ Pour conclure, 1'exposé suggère quelques solutions de rechange en vue d'améliorer à l'a

Abstract.This study is based on examination of a randomly selected sample of 2,150 letters representing all the mail received by Prime Minister Trudeau between February 1969 and June 1972. The object of the study was to ascertain the characteristics of the letter‐writers and the nature of their concerns, arguments and strategies. Through interviews with the staff of the Correspondence Section of the Prime Minister's Office we were also able to discover how the mail is processed. This is described in the last section of our paper.As one might expect, the mail is unrepresentative of the regional, linguistic and class diversity of Canada. Metropolitan areas, rich provinces and English‐speakers are over‐represented, as are people who have access to typewriters. There is, however, a sizable group of letters from the very poor who write the Prime Minister to complain of their victimization by government bureaucracy or by life in general. These letters are personal and apolitical and approach the Prime Minister in a deferential manner. They appear to us to be carefully and sympathetically answered, and to be probably effective in rectifying small problems. The bulk of the mail is policy‐oriented, but probably not effective in influencing policy. Public attention to policy, as expressed in the mail, is extremely transitory and focuses particularly on topics with strong emotional content or on those affecting economic welfare. The mail seems only weakly related to the government's own policy priorities.Sommaire.Cette étude est fondée sur un échantillon de 2,150 lettres tirées du courrier par le premier ministre Trudeau entire février 1969 et juin 1972. Nous avons voulu identifier les catégories de personnes qui s'adressaient au premier ministre, et déterminer le but de leur correspondence et la nature de leur argumentation etc. Nous avons interviewé le personnel de la section de la correspondance du cabinet du premier ministre pour connaître la procédure de réponse à ce courrier.Nous avons constaté que le courrier n'est pas représentatif de la diversité régionale, culturelle et sociale du pays. Les plus fortunés, les habitants des grandes villes, et les habitants des provinces sont surreprésentés. II y a, cependant, une proportion assez élevée de lettres venant d'économiquement faibles qui se plaignent au premier ministre de leur traitement par la bureaucratic ou de la vie en générate. Leurs problèmes sont formulés en termes personnels, et ces personnes s'adressent au premier ministre respectueusement. Les réponses à ces lettres nous paraissent sympathiques et souvent efficacies quant au redressement des plaintes. Le gros du courrier concerne l'orientation de la politique mais son influence est sans doute limitée. Abstract.The focus of this article is on the external controls of legislation and of judicial decisions arising out of the application of law, statutory and other, to the activities of public servants. It also discusses the impact on administrators of administrative adjudication.Acts of Parliament are, it is conceded, very important controls on official actions. That does not mean as much as it appears, however, because of the influence which senior officials have over the detailed provisions of statutes. Subordinate legislation is much less effective, not only because public servants largely determine its content, but also because there is no tradition of reverence for this form of law.Despite the fact that the judiciary is not that effective as a control on administrative behaviour, it is argued that the courts can intervene meaningfully at least when judicial and quasi‐judicial decisions are at issue. Even so, only a small proportion of such decisions are ever challenged in the courts, including the new Federal Court. Nor is there much prospect of the judiciary becoming significantly more effective than it now is as a control over administration. If discretionary powers, particularly legislative and administrative, are to be effectively supervised it will have to be by Parliament.Sommaire.Le thème central de cet article concerne les contrôles externes de la législation et des décisions judiciaires découlant de l'application de la loi, statutaire ou autre, sur les activités des fonctionnaires. II discute aussi de leur effet sur les administrateurs chargés de l'adjudication administrative.Les lois du parlement constituent, on l'admet, des contrôles très important; des actes officiels. Ils n'ont pas cependant autant d'impact qu'il parait à cause de l'influence que les cadres supérieurs ont sur les dispositions spécifiques des statuts. La législation déléguée est beaucoup moins efficace, non seulement parce que les fonctionnaires en déterminent la teneur dans une large mesure mais aussi parce traditionnellement cette forme de loi ne commande pas beaucoup de respect.En dépit du fait que le contrôle judiciaire n'est pas très efficace sur le comportement administratif, on croit que les tribunaux peuvent intervenir de façon significative, du moins lorsqu'il s'agit de decisions judiciaires ou quasi‐judiciaires. Mais même dans ce cas, une faible proportion seulement de ces decisions est mise en question devant les tribunaux y compris la nouvelle Cour fédérale, et il y a peu de chance pour que le judiciaire augmente sensiblement son efficacité, quant au contrôle de radministration.
