摘要:
This article reviews the strengths and weaknesses of Environmental Impact Assessment, or as we prefer Environmental Assessment (EA), as a tool for environmental management. EA has had many roles: a passive role of advising decision-makers, a more active role of mitigating impacts through design changes, an important educative role, and a community empowerment role. While EA has had a pivotal role in the development and evolution of environmental management in Australia and elsewhere, and remains an important tool, it is no longer at the cutting edge. By and large there has been far too much focus on procedural aspects of EA to the detriment of the substantive purpose of EA. We suggest in this article that we should steadily be moving beyond narrow conceptions of EA to incorporate the many valuable perspectives and techniques that have evolved as part of the collective experience of conducting environmental assessments directly into project design, land use planning and policy development activities.

摘要:
Environmental Impact Assessment (EIA) is a commonly applied mechanism for managing adverse environmental effects of development. While there are widespread requirements for undertaking EIAs within Australia, there remain limitations in the capacity to meet all expectations. Such limitations are mostly apparent in relation to land use planning, natural resource management and the assessment of cumulative environmental impacts. Improved methods and procedures are needed to achieve more effective development planning and natural resource management and to implement the principles of ecologically sustainable development. They include improved information systems, better scoping mechanisms, more rigorous predictive modelling and broader assessment methods including area-wide and strategic environmental assessments.

This article examines the role of public inquiries in environmental assessment. It provides an overview of federal inquiry practice, but emphasises inquiries under the Environment Protection (Impact of Proposals) Act 1974 (Cth) (EPIP Act), including the recent Commission of Inquiry into the Shoalwater Bay Area. The article examines a number of weaknesses in the current inquiry system, analyses why there have been so few inquiries under the EPIP Act, and proposes ways to enhance their potential.

摘要:
Environmental Assessment (EA) in New Zealand has undergone significant change as a consequence of recent reforms. The article outlines provisions for EA in the Resource Management Act 1991 and reviews progress in its implementation. Innovative features such as provision for environmental assessment of local government plans are highlighted. Different styles of planning and environmental assessment are identified. Application of EA at the policy level is variable but is an inevitable outcome of a system which is devolved and flexible. The article concludes that the unique way in which EA has been integrated in the Act may make evaluation of its effectiveness difficult.

Recent changes to Canadian Environmental Assessment (EA) processes and practices are described. Particular attention is given to the comprehensive reforms made at the federal level. These encompass, inter alia, a new legal regime for project EA and the introduction of a Cabinet directive on policy-level assessment. Operational changes presaged under the Canadian Environmental Assessment Act 1995 are evaluated in terms of whether they constitute a much improved process that is consistent with sustainability objectives and principles. In that context, policy-level assessment is of even greater potential signficance; however, to date, the record of application by federal agencies is mixed at best. Federal experience is also compared with trends and developments in provincial EA processes. The paper concludes with a review of the challenges facing Canadian EA practice, in general; and readers may note parallels with Australian experience, whether coincidental or reflecting a similar constitutional inheritance and geopolitics of federalism.
