AbstractThe ethical norms of attorneys in mental health law practice are guided by regulatory codes, professional standards, constitutional, evidentiary, and procedural laws, and personal moral values. This article addresses the contours of ethical practice for attorneys in their relationship with mental health experts. In particular, it examines the attorney's responsibility to zealously represent their clients and the ethical limits on such advocacy.

Issues which are discussed include the necessity of expert testimony, selection of the expert, and the data underlying the expert opinion. In addition, the attorneys' responsibilities in presenting the mental health expert in court is discussed with reference to different elements of the trial process.

AbstractEthical issues emerging from forensic assessments are addressed from clinical and research perspectives. The relevance of agency, forensic identification, and attitudes toward defendants are explored within the framework of ethical practice. Finally, the ethical role of mental health professionals in the courtroom, the scope and basis of their testimony, and the rendering of conclusory opinions are discussed within a psycholegal context.

AbstractAll 51 jurisdictions in the United States require physicians to report suspected child abuse. In most jurisdictions, reporting requirements override both confidentiality and privilege associated with the physician‐patient relationship. The authors review the literature relevant to the conflict between privacy and reporting abuse and report the results of a national survey of therapists at sex offender treatment units. They discuss ethical problems experienced under these statutes by therapists who attempt to provide treatment for sex offenders, and by therapists who are required to report past instances of child abuse even when there is no evidence of ongoing abus

AbstractIn every American state with a death penalty law, execution of the insane is forbidden by statute or case law. Recently, the United States Supreme Court held that this proscription is mandated by the Cruel and Unusual Punishment Clause of the Eighth Amendment. As a result of these laws and the Supreme Court's recent ruling, psychiatrists and psychologists have been and will continue to be called upon to both diagnose and treat insanity among death row inmates. This article considers whether psychiatrists and psychologists can meet both these legal demands and the ethical demands of the healing professions to which they belong.

AbstractEthical issues in research are especially important when working with confined populations such as prisoners. One method that has been proposed to assist the decision‐making process is the use of a risk/benefit model. The informed estimation of the probable risks and potential benefits of any given research project should be used to determine the ethical justifiability of conducting the research. The present article enumerates the variables relevant to a risk/benefit analysis when conducting research in a prison setting. Also, the risks of undue influence and the limits of confidentiality will be discussed. Finally, the appropriate use of informed consent will be discussed as a safeguard against these risk

AbstractDescriptive statistics were collected on a group of 184 men determined to be sexually dangerous and incarcerated in a correctional/mental health facility designed for the treatment of sexual offenders. Data were obtained by reviewing each patient's clinical file and abstracting information on over 600 discrete variables. Selected variables from that database were rationally grouped into five categories: (1) family, (2) child/juvenile, (3) adult/incompetence, (4) criminal, (5) clinical. Descriptive statistics were used to assess the prevalence of various characteristics among the entire sample, as well as between groups of rapists and child molesters.
