Certain key disputes remained unresolved after extensive and for the most part successful efforts by the Columbia River Estuary Study Taskforce (CREST) to develop a management plan for the Columbia River estuary and its shorelands. The remaining disputes, involving conflicts between resource protection and port development, were resolved by the mediation process described in this paper. This process, involving exploration, process design, negotiation, and implementation phases, led to the signing of an agreement by twelve negotiators, the subsequent endorsement of the agreement by the federal, state, and local governmental bodies they represented, and the incorporation of the terms of the agreement into the comprehensive plans of local governments. The agreement describes the particular kinds of port‐related development that might be appropriate at specific sites in the estuary and the conditions under which such development might take place. It also outlines areas where development alteration would not occur. For some of the sites it presents constraints on dredge‐and‐fill activities, turning basin and navigation‐channel depths and widths, corridors for pilesupported causeways and accessways, and mitigation policies.

Shoreline erosion and coastal development are management issues in the Great Lakes region that periodically rise with lake levels to crisis proportions. For four years, local governments in Racine County have used a group of trained volunteers to gather information at the coast in order to exercise timely management of coastal development.

The recently adopted Law of the Sea (LOS) Convention contains a provision allowing coastal nations to adopt 12‐mile territorial seas. Already 104 nations (of a total of 137 coastal nations) have claimed territorial seas of 12 miles or wider. The paper discusses the factors which, in the opinion of the authors, could cause the United States to broaden its territorial sea from the present 3 miles to 12 miles within the next half‐dozen years or so. The state‐federal ocean use and resource management issues that will be raised by such a move are reviewed and options for dealing with the jurisdictional issues are developed. Given the political and economic volatility of these issues and their complexity, the use of a broadly representative and well‐staffed study commission to formulate a course of action is suggested.

The United States currently has a 3‐mile territorial sea limit which is under the jurisdiction of coastal states. In the event the United States joins with other countries in adopting a 12‐mile territorial sea, Congress may consider extending state jurisdiction to 12 miles. It may be in the best interest of coastal states to oppose extension and instead support a strengthened federal‐state ocean management regime which disregards boundary lines and is based on the sharing of outer continental shelf leasing revenues along with a guaranteed role for coastal states in federal decision‐making.

In December 1977, NOAA Administrator Richard Frank created an Office of Ocean Management to assess the impact of alternative ocean uses in intensively used ocean areas, to coordinate and advocate NOAA's evaluation of proposals for ocean use, and to implement the Marine Sanctuary Program. The overall objective of the Office was to serve as a focal point for NOAA's role as the lead civilian ocean agency. The Office's small staff immediately found itself pulled in many directions and overwhelmed by the number of tasks and the range of pressures it faced. Controversies over the Marine Sanctuary Program and offshore leasing led to the refusal of Congress to provide funding for the Office, which was merged into the Office of Coastal Zone Management in October 1978. This article reviews the history of the Office and the lessons that can be learned from the attempt to coordinate ocean activities at the federal level.
