AbstractThis research addresses the influence of mandate design upon implementation efforts and regulatory styles. Empirical analyses of these relationships are conducted for state‐level land‐use and development‐management mandates enacted by California, Florida, North Carolina, Texas, and Washington. Three key findings provide insights about the role of mandate design in facilitating policy implementation. First, implementation efforts are more easily influenced than regulatory styles. Second, it is more difficult to foster conciliatory regulatory styles than it is to foster more legalistic styles. Third, a high degree of statutory coherence is not a necessary condition for strong implementation efforts. AbstractThis study asks whether short‐term cutbacks made during a fiscal crisis become permanent once fiscal conditions improve. Hypotheses are developed to establish a framework for analyzing a time‐series data set. These hypotheses address trade‐offs between less essential versus more essential services, salaries versus positions, and capital versus operating expenditures. Then long‐term consequences are assessed with a longitudinal, comparative case study of the effects of New York City's mid‐1970s fiscal crisis on education services in the city. Education services were cut dramatically in 1976 and 1977. The trends in those services, defined in various ways, are compared over time and in relationship to the rest of New York State. We find that less essential services, teacher positions, and capital and maintenance expenditures suffered, relative to more essential services, operating expenditures, and teacher

AbstractIn this article we introduce a policy analytic technique that we call “policy monitoring.” Using data from the Environmental Protection Agency's Hazardous Waste Division, we demonstrate how the technique can be employed in actual practice. The case study demonstrates that EPA enforcements were responsive to stimuli emanating from outside the agency. In particular, relevant congressional committees were able to influence and effect change in the EPA's policy. AbstractMany concerned with how government functions consider creating competition between bureaucracies an attractive option. Others are skeptical of what impact rival agencies have when they are operating within a political context. Reflecting these discrepant viewpoints, some scholars believe that regulators will compete vigorously for resources and responsibilities; others assert that agency members will act passively as they attempt to protect their autonomy.To assess these contrasting perspectives and determine why competitive agency structures might exist, the following analysis examines one of the classic situations where agencies can serve as functional substitutes: the relationship between the United States Forest Service and the National Park Service. The results demonstrate that agencies put far more weight on autonomy than competition. AbstractOver the past few years, price caps have replaced rate‐of‐return regulation in many sectors of telecommunications. This article focuses on the key implementation issues raised in the Federal Communications Commission's formulation of price cap plans for AT&T and the local telephone exchange carriers. Specifically, it discusses company cost changes over time and the formulas employed to track costs; the multiplicity of prices and the structure of regulations designed to cap them; and the inevitability of errors in the long run and the disincentives likely to result from efforts to correct such errors. AbstractThis article reports on empirical tests of two theories for improving compliance with state environmental regulations. One theory argues for centralization of enforcement responsibilities with state agencies, while the other focuses on enforcement strategies, arguing for an approach that emphasizes capacity building and the social and moral bases of compliance in addition to deterrence and the threatened application of sanctions. Using evidence from North Carolina, we show that centralization does not necessarily enhance compliance, but cooperative enforcement strategies can improve the effectiveness of regulations that seek to attain performance standards. Compliance with simpler specification standards, however, can be attained just as well with easier to administer deterrent enforcement strategies based on frequent inspections and adequate sanctions.
