A review of legal challenges to the use of military force, from the Vietnam War era to the Gulf War, demonstrates a judicial unwillingness to constrain presidential policymaking. In most of these cases, the judiciary has ruled the legal challenge nonjusticiable. In the first post‐Cold War challenge, Dellums v. Bush,the United States District Court for the District of Columbia issued the equivalent of a declaratory judgment. Arguably, this is the only practical judicial response to the presidential use of force, but it does little more than redirect the policy conflict from the courts to Congress. Why do consumers often react with alarm to food technologies (such as irradiation, genetic engineering, artificial hormones, and chemical pesticides) that scientists regard as essentially safe? We examine the attitudes toward food safety of three types of elites who serve as providers of scientific information regarding food safety to the United States public. Previous research suggests that journalists are likely to exaggerate risks associated with emerging food technologies, while minimizing risks associated with natural pathogens. This bias is hypothesized to be political in origin. By and large, our sample of newspaper editors was only slightly more concerned than were United States government policymakers and a sample of scientists. The expected pattern of alarm occurs clearly only in the case of irradiation. In addition, modest correlations of ideology to safety assessments were found for all three types of elites.

In the last two decades, many states established rail promotion programs in an effort to limit the contraction of their railroad networks. Now federal funds for rail projects are nearly exhausted, and states must decide whether to expand considerably their levels of internal funding for short line investments. Such a decision requires a careful articulation of policy goals, combined with sound cost‐benefit techniques. Research shows, however, that states often fail to evaluate the full range of costs and benefits when considering rail investments. Instead, the economic development benefits of local rail service frequently are overstated, while the potential for rail investments to meet broader transportation planning needs is neglected. This paper evaluates the rationale behind state intervention in the rail industry, discusses the tendency of states to focus on economic development to the exclusion of other benefit categories, and presents summary results from an analysis of an investment project in North Carolina. The paper suggests that state funding for rail projects is more likely to be justified based on intermodal substitution benefits generated by local rail service, rather than the railroads' potential to increase job

Utilizing data from a survey of 60 national public interest group founders, this paper addresses two related questions: (a) What factors explain the (relatively) recent proliferation of public interest groups? (b) What factors determine in which policy areas public interest group activity is most likely? The results of the data analysis suggest that several factors have contributed to group proliferation. Among the most important are law group start‐up costs, the spread of affluence and education, an increase in patron activity, and rapid societal change. The results also suggest that public interest group activity is most likely in issue areas of interest to well‐educated, affluent whites. Ultimately, however, the data suggest there is bound to be a great deal of uncertainty in the public interest group universe. Because group start‐up costs are so low and the entrepreneurial pod is so large and varied, virtually any type of public interest group dealing with any issue could form at any

Deficit politics, airline deregulation, and the prospect of a windfall of cash has prompted many local units of government that own and operate airports to consider selling or leasing these facilities to private investors. Airport privatization has emerged as a contentious issue, with weighty arguments on both sides of the debate. This article examines these arguments and presents several models of airport privatization. The authors suggest that the most aggressive form of privatization–full divestiture–is unlikely to produce the benefits advertised by its proponents. However, less radical forms of privatization serve as useful models for future airport ownership and operation. Municipal solid waste management and planning traditionally have been regarded as the responsibility of local government. However, the legal climate surrounding solid waste management has become more constrained, placing local government at the mercy of the private waste management industry, and eroding the effectiveness of local waste planning efforts. This article provides an overview of recent court decisions impacting local government solid waste management. It also discusses current congressional activity relating to interstate waste transport and flow control, and assesses the potential effects of such legislation on public solid waste management and on privatization issues raised by critics of local control.
