Abstract:About one in five of defendants charged with triable‐either‐way offences is dealt with at the Crown Court. Yet a majority of those committed to the Crown Court because magistrates decline jurisdiction receive sentences which magistrates could have imposed. Among those electing trial, most of those convicted ended up pleading guilty and the research showed that many will have received much more severe sentences as a result of going to the Crown Court. Substantial differences were found in the sentencing pattern of individual courts, but the biggest difference was between the higher and lower courts with many more, and longer, custodial sentences being imposed at the Crown Court for similar offen

Abstract:This article discusses briefly the role that might be played by pre‐trial review (PTR) hearings in promoting the efficient handling of criminal cases in the magistrates' courts. It then summarises some of the findings of an evaluation study undertaken by the authors in two busy inner‐city courts which have slightly different systems for pre‐trial review. Efficiency gains are measured in tern of case‐settlement and case‐streamlining and the results are discussed in the context of whether the observed outcomes of PTRs have had an unacceptable impact on the delivery of substantive justice to the defendants in the cases

摘要:
The Swansea Listener Scheme is based on the belief that Samaritan principles of sympathetic listening can be applied formally within a prison setting. Samaritans are ordinary people trained to befriend others in confidence, without administering advice or judgment. Ordinary prisoners can also befriend, within a confidential setting, those who feel vulnerable or suicidal. Trained and supported by the Samaritans, the services of a volunteer Listener can mean the deference between coping with prison, or simply giving up. Since its inception at Swansea Prison in August 1991, the incidence of recorded self‐harm has been halved. This study, based on extended interviews with Listeners and staff, suggests that the implications of the scheme go well beyond the prevention of suicide, and have a positive effect on relationships between stag, prisoners and caring agencies within the communit

Abstract:It was hypothesised that prison inmates assimilate into a normative prison culture comprised of violence producing admissions of future crime. Thus, 462 inmates in three dqferent custody level prisons and a control group of 126 university students were surveyed. Results show that non‐violent offenders in high custody facilities admit that they might commit violent crime, once released. However, violent offenders in a work release centre claim that violent crime is not an option for them. A conclusion arising from these findings is that organisational membership impacts attitudes; also high custody prisons are sources of violence leading to higher violent crime rates.
