Sommaire.Le grand défi du droit administratif moderne est de réussir à concilier les nécessités administratives avec le respect des droits des citoyens. En raison du rôle qu'il joue au sein de l'administration publique, le juriste fonctionnaire est souvent appeléà favoriser cette conciliation. A cette fin, une bonne connaissance des deux principales sources d'inspiration du droit administrative ‐ la jurisprudence et la législation ‐ lui est essentielle. Par exemple, à titre de recherchiste ou de conseiller, il doit conseiller l'administration de façon Claire et efficace sur les changements qu'elle doit apporter à ses procédures ou à son action pour demeurer dans la léalitéà la suite de certains jugements des tribunaux. A titre de plaideur, par ailleurs, il doit éviter de proposer trop rapidement à son employeur une modification législative pour régler un contentieux avec un administré sur une question d'interprétation, une fois que le processus d'intervention judiciaire a été mis en marche. De la même façon, il ne doit pas utiliser indûment la disproportion des forces en présence comme moyen de pression pour forcer un réglement hors‐cour ou, à l'inverse, pour refuser toute négociation là où un compromis serait acceptable. Enfin, le juriste de la function publique qui a pour tâche de rédiger la législation ou la règlementation doit s'assurer qu'il en saisit bien toutes les implications pratiques. A cette fin, il ne doit pas hésiter à rencontrer les personnes susceptibles d'être touchées et à les consulter. Une telle démarche permet d'éviter plus facilement des solutions bureaucratiques qui peuvent causer des ennuis inutiles aux citoyens.Abstract.The need to reconcile the demands of the administrative process with a respect for the rights of the individual represents the greatest challenge for modern administrative law. In this regard, lawyers within the public service have a special role to play. To do so requires that they be thoroughly familiar with the two main sources of administrative law: case law and legislation. For example, as a result of a particular court decision, they may have to advise the government on the implications of the decision for the administrative process and how this might be altered. Further, once the judicial process has been set in motion, they must refrain, in disputes involving statutory interpretation, from suggesting to the government immediate amendments to the legislation. Also, they must not be over‐eager to bring about an out‐of‐court settlement by emphasizing the disproportionate resources available to the government in court matters. On the other hand, they must not refuse to negotiate acceptable compromises. Finally, when drafting bills they must be cognizant of the practical consequences of the legislation. Abstract.The content of science, at least that of the natural and exact sciences, is largely viewed as transnational, i.e. devoid of important peculiarities traceable to the political, social or cultural environments in which science develops. Yet policies affecting science in each individual country are known to vary substantially one from the other. For this paper, two rather different countries have been selected, the Soviet Union and Canada.The paper begins with the historical circumstances of, and expectations linked to, the transfer of modern science into each of the two countries. Resulting patterns of science organization are discussed, with particular emphasis being placed on the role of the central governments. Express attempts to foster science in order to catch up economically with older industrialized nations are characterized and their impact assessed. Finally, the contributions of scientists to formulation of science policies for their countries are analysed and linked with the prevailing patterns of employment of Canadian and Soviet scientific manpower.Sommaire.La matière des sciences, tout au moins des sciences naturelles et exactes, est généralement considérée comme transnationale, c'est‐à‐dire comme dépourvue de particularités importantes relevant des milieux politiques, sociaux et culturels dans lesquels elles se sont développées. Et cependant, on sait que les politiques qui, dans chaque pays, ont des répercussions sur les sciences différent considérablement entre elles. Pour cette étude, l'auteur a choisi deux pays trés différents: l'Union soviétique et le Canada.Il commence par exposer les circonstances historiques du transfert des sciences modernes dans chacun de ces deux pays ainsi que les attentes qui en découlent. Il étudie ensuite les scénarios qui s'en dégagent pour l'organisation des sciences en insistant plus particulierement sur le rôle du gouvernement central. Il décrit des efforts délibérés pour encourager les sciences afin de rattrapper économiquement les nations plus anciennement industrialisées et évalue l'effet de ces tentatives. Abstract.The purpose of this article is to explore the difficulties inherent in the organization of local government in large and geographically remote areas and the responses to those problems over time in a comparative cross‐provincial perspective. After defining the provincial north, the article traces the origin and early development of local government structures in the provincial north to indicate just how these structures differ from those in the southern regions of the provinces. The article then discusses the range and nature of the problems faced by northern communities. This is followed by an analysis of the desires of northern local governments and the manner in which they express them. The final section describes the nature of governmental responses to the demands expressed by local governments.Sommaire.Le but de cet article est d'enqêter sur les difficultés inhérentes à l'organisation du gouvernement local dans de grandes régions gégraphiquement isolées et le traitement de ces problèmes sur une période de temps et ce dans une perspective interprovincial comparative, Après avoir défini le nord provincial, l'auteur retrace l'origine et l'ébauche du développement des structures de gouvernement local dans le nord provincial pour montrer en quoi celles‐ci diffèrent de celles des régions du sud des provinces. Sommaire.Dans cet article portant sur la gestion de l'enseignement supérieur, au Québec, l'auteur fait porter l'essentiel de son analyse sur le rôle du ministère de l'Education comme principal gestionnaire du système universitaire québécois. Dans une première partie, il situe le ministère dans l'ensemble de ce système et décrit globalement le type de relations qui existent entre les divers agents ou intervenants en matière de planification et de gestion. L'accent y est mis, en particulier, sur la planification des ← missions → universitaires et sur le contrôle exercé par le ministère dans le cadre de la gestion de celles‐ci. S'inspirant, dans une seconde section, d'une certaine typologie des contrôles, l'auteur tente d'en préciser la nature et d'en mesurer l'étendue dans un contexte où les établissements universitaires jouissent d'une large autonomie de gestion. Enfin, dans une troisième partie, plusieurs interrogations sont soulevées par auteur notamment à propos de l'efficacité des contrôles exerés par le ministère et des effets de ceux‐ci sur le fonctionnement du système et son environnement.La démarche retenue par l'auteur amène le dernier, à faire quelques suggestions en matière de planification, budgétisation et contrôle de l'enseignement supérieur québécois.Présenté, pour la première fois, à la Commission d'etude sur les universités, en 1978, cet article a, par la suite, fait l'objet de modifications importantes, notamment au chapitre de l'évaluation de l'efficacité des contrôles exerés parle ministère de l'Education.Abstract.In this article on the management of higher education in Quebec, the author concentrates his analysis on the role of the Ministry of Education as principal administrator of Quebec's university system. He first establishes the ministry's place within the system and broadly describes the relationships between the various agents or interveners in the field of planning and management. Particular emphasis is given to the planning of university ‘missions’ and the extent of ministerial control over their management. In a second section, the author, on the basis of a certain typology of controls, seeks to define their nature and measure their extent in a context within which universities enjoy considerable administrative autonomy. Finally, the author poses a number of questions as to the effectiveness of the controls exercised by the ministry and their effect on the system's functioning and its environment.The method chosen by the author leads him to make a number of suggestions at the levels of planning, budgeting and control of higher education in Quebec.Submitted to the Commission d'étude sur les universités for the first time in 1978, this article has undergone major modifications, particularly in the section dealing with the effectiv

Abstract.Modernizing local government systems to meet changing needs and urbanization is common to most Western democracies. This article examines the British local government modernization which, it argues, placed far too much emphasis on improving the system's functional capacity and too little to improving its democratic quality. The overemphasis on functionalism has been most decisive in relation to creating wider areas for planning and transportation and creating more populous local units so as to exploit economies of scale. The result is a system with some of the largest local units among Western democracies. The new system is also very unpopular. Yet, even when judged in functional terms it has serious weaknesses especially in regard to its failure to recognize the different functional needs of urban and rural areas.The article makes a strong plea for the restoration of democratic as opposed to functional criteria in the design of local government systems and notes the contribution that public choice theory can make to local government reorganization by its insistence on distribution efficiency as opposed to production efficiency.Sommaire.La modemisation des systèmes de gouvemement local pour répondre à de nouveaux besoins et aux exignences de l'urbanisation est commune à la plupart des démocraties occidentales. L'auteur de cet article étudie la modemisation du gouvernement local britannique qui, à son avis, a trop porté sur l'amélioration de la capacité fonctionnelle du système et pas assez sur sa qualité démocratique. La trop grande importance accordée au fonctionnel a joué un rôle particulièrement décisif en créant de grandes régions pour la planification et le transport et des unités locales à très forte densité de population de façon à profiter des économies d'échelle. Le résultat, c'est un système qui compte certaines des unités démographiques les plus fortes dans les démocraties occidentales. Ce nouveau système est aussi très impopulaire. Etmême lorsqu'on le juge du point de vue fonctionnel, il accuse une très grave faiblesse en ne distinguant pas entre les besoins fonctionnels différents des régions urbaines et rurales.L'auteur plaide en faveur de la restauration de critères démocratiques plutôt que fonctionnels pour la conception de systèmes de gouvemement local et il indique la contribution que pourrait apporter la théorie du choix public à la réorganisation du gouvernement local grâce à son insistance sur l'efficacité de la distribut

Abstract.In an attempt to promote joint planning in the field of economic development, the federal government signed General Development Agreements with the provinces. Under the agreements, the two bureaucracies are linked together and are charged with jointly developing and implementing programs. Decision‐making authority is delegated to a series of federal‐provincial committees. To make these committees work and to carry out joint planning and decision‐making with provincial governments, Ottawa through its Department of Regional Economic Expansion decentralized to offices located in provincial capitals the required authority.An examination of the GDA decision‐making process reveals that this new approach to decision‐making holds far‐reaching consequences for provincial political‐administrative institutions. The interdependence which the GDA approach creates between provincial government and provincial DREE officials has strengthened considerably the role of the provincial bureaucracy. The impact is such that the established boundaries between provincial government officials and provincial cabinet ministers have been altered. This in turn has also altered traditional relationships which have existed between provincial cabinet ministers and other members of the Legislative Assembly.In short, while the GDA approach has had only a limited impact on the large federal bureaucracy, it has entailed significant consequences for the smaller provincial government bureaucracies.Sommaire.Dans le but de promouvoir une planification conjointe dans le domaine du développement économique, le gouvernement fédéral signe avec les provinces des accords généraw de développement. Dans le cadre de cesaccords, la deux bureaucraties travaillent ensemble et sont responsables conjointement de l'élaboration et de la mise en oeuvre des programmes. La prise de décision est confiée à différents comités fédéraux‐provinciaux. Pour permettre à ces comités de fonctionner et d'exécuter la planification et la prise de décision de concert avec les gouvernements provinciaux, Ottawa, par l'intermédiaire du Ministère de l'expansion économique régionale, a décentralisé et confié l'autorité nécessaire à des bureaux situés dans les capitales provinciales.Un examen du processus de prise de décision dans le cadre des AGD révèle que cette nouvelle approche a des conséquences de très grande portée pour les institutions politico‐administratives provinciales. L'interdépendance entre le gouvemement provincial et les autorités provinciales DREE, que crée l'approche AGD, a consolidéénormément le rôle de la bureaucratie provinciale. L'effet a été tel que les champs d'action des responsables du gouvernement provincial et des ministres du cabinet de la province en ont été modifiés, ce qui, à son tour, a eu pour effet de changer les rapports traditionnels qui existaient entre les ministres du cabinet provincial et les autres membres de l'assemblée législative.En résumé, l'approche AGD n'a eu qu'un effet limité sur l'importante bureaucratie fédérale mais ses conéquences sont beaucoup plus lou
