Abstract:Administrative tribunals represent a broad range of diversity in their features. Nevertheless, they share certain functions with each other which in turn suggest the appropriate procedures each should follow and the manner in which they should conduct their business. In recent years, our courts have demonstrated considerable deference to administrative decision‐making. Nevertheless, problems have been created by the invocation of section 96 of the Constitution Act, 1867 to strike down provincial tribunals and the full impact of the Canadian Charter of Rights and Freedoms has yet to be felt.A high priority for the future must be to establish greater security for tribunal members and independence from departmental constraints in the execution of tribunal business. The transfer of all responsibility for independent tribunals to the Minister of Justice, as now exists with respect to the judiciary, might prove to be an important first step.Meanwhile, administrative tribunals will continue to serve Canadians in the dynamic process of developing law and policy and in making decisions, in interaction with judicial, governmental, and political processes, in vital areas which so profoundly affect the lives of so many Canadians.SommaireLes tribunaux administratifs présentent des caractéristiques variées. Nean‐moins, ils partagent certaines fonctions communes qui, à leur tour, suggèrent le type de procédures que chacun devrait suivre et la façon dont ils devraient procéder. Au cours des dernières années, les cours de justice ont manifesté beaucoup de respect envers la prise de décision administrative. Toutefois on a utilisé l'article 96 de la Loi constitutionnelle de 1867 pour invalider les tribunaux administratifs provinciaux, ce qui a créé des problèmes, et l'impact réel de la Charte canadienne des droits et libertés ne s'est pas encore fait sentir.Il est important dans l'avenir d'assurer une plus grande sécurité aux membres des tribunaux et d'accroître leur autonomic vis‐à‐vis des contraintes ministérielles. Abstract:This article examines the relationship between the role of the public service and the extent and limits of its power. It raises, first, the issue of die severe limits to die power of the government in general and die public service in particular. It dien explores a pivotal paradox, namely, that of an apparently powerless public service possessing, in fact, very significant power to influence public policy and program direction. The various roles are identified which, by their nature, give die public service its power base. These roles are diose of policy implementer, policy advisor and developer, policy advocate, policy maker, adjudicator, and linch‐pin. The reciprocal nature of the power relationship is noted through which those in positions of power are controlled by those diey seek to control. Eight sets of public service power‐holders are identified and their characteristics noted: the managerial cadre; support specialists; the unions; the central agencies; collegial departments; agencies able to exert horizontal controls; the common service agencies; and quasi‐judicial bodies.SommaireCet article examine la relation entre le rôle de la fonction publique et l'éten‐due et les limites de son pouvoir. II soulève, d'abord, la question des limites impor‐tantes que connaît le pouvoir du gouvernement en général et celui de la fonction publique en particulier et examine ensuite le paradoxe d'une fonction publique en apparence sans pouvoir mais qui, en fait, détient un pouvoir très important dans la formulation des politiques publiques et l'orientation des programmes. On identifie les divers rôles qui, de par leur nature, fondent le pouvoir de la fonction publique. Ces rôles sont ceux d'exécutant de politiques, de conseiller et de concepteur de politiques, de promoteur de politiques, d'adjudicateur et de coordonnateur. On remarque que la relation de pouvoir n'est pas à sens unique, de sorte que ceux qui sont dans des positions de pouvoir sont contrôlés par ceux qu'ils doivent contrôlér. Huit groupes de détenteurs de pouvoir dans la fonction publique sont identifyés et leurs caractéristi‐ques sont notées: les cadres de direction; les spécialistes de soutien; les syndicats; les organismes centraux; les ministères collégiaux; les organismes exerçant des controles horizontaux; les organismes de service commun;

Abstract:The article examines the political administration of government reorganization through an analysis of the 1982‐83 merger of the Department of Industry Trade and Commerce (ITC) and the Department of Regional Economic Expansion (DREE) to form the Department of Regional Industrial Expansion (DRIE). Three issues of political administration are examined: the role and sustainability of prime ministerial power; the partial clash between policy and organization; and field versus headquarters operations. The slowness of the reorganization process is attributed to an inevitable sag in prime ministerial power, to line department versus central agency clashes over policy versus organizational imperatives, and to headquarters‐field tensions over the practical meaning of delegated authority in the midst of the reorganization.SommaireL'article examine l'administration politique de la réorganisation gouvernementale en faisant 1'analyse de la fusion en 1982–1983 du ministère de l'In‐dustrie et du Commerce et du ministère pour l'Expansion économique régionale, d'où est résulté le ministère pour l'Expansion industrielle régionale. Abstract:This essay puts forward a reformulation of the federal government's aging policy and is intended to bring out the diversity of policy processes that operate in this field of political action. Four policy arenas are identified: the large‐new, large‐old, small‐new, and small‐old. Applying this typology, it becomes apparent that the existing Canadian age‐policy literature has been mostly concerned with just one of these four categories, namely the large‐new, while tending to neglect the other three. Since the roles of senior citizen organizations and the federal bureaucracy, although acknowledged in previous writing, have not been specified precisely nor fully analysed, special attention is devoted to them. While both of these forces are shown to exercise some considerable influence over aging policy in Ottawa, the relative extent of their influence is seen to vary among the various arenas, with the senior citizen groups tending to have their greatest influence in advancing “new” policy proposals ‐ both large and small ‐ while the bureacracy is found to exert its impact more with respect to existing (“old”) programs, both large and small. The results make it possible to identify with some precision the particular functions fulfilled by each of these forces in the policy process.Sommaire: Cet article présente une reformulation de la politique du gouvernement fédéral concernant le vieillissement et vise á mettre en lumiére la diversité des processus politiques à l'oeuvre dans ce domaine. Quatre arénes de politiques sont identifyées: les majeures‐nouvelles, les majeures‐anciennes, les mineures‐nouvelles et les mineures‐anciennes. L'application de cette typologie fait apparaître clairement que la littérature existante sur la politique du vieillissement au Canada s'est surtout in‐teressée à une seule de ces quatre catégories, celle des majeures‐nouvelles, et qu'elle à eu tendance à négliger les trois autres. Étant donné le peu de cas qu'ont fait les ouvrages antérieurs du rôle joué par les organismes de personnes âgées et par la bureaucratie fédérate, l'auteur lui accorde ici une attention particuliére. Bien qu'il ressort que l'une et l'autre de ces forces exercent une influence considérable sur la politique du vieillissement à Ottawa, on voit que l'ampleur relative de leur influence varie suivant les diverses arénes. Sommaire:: Les méthodes de gestion du secteur privé peuvent‐elles s'appliquer au secteur public? Certainement pas intégralement, un obstacle majeur tient au systéme budgétaire des gouvernements. Ce systéme en effet ne permet pas à un administrateur de relier les coûts d'une activitéà une forme quelconque de revenus qui y serait associée et de régulariser les dépenses en conséquence. La formule du Fonds renouvelable fait exception. Tout en demeurant intéagré au cadre financier gouvernemental le Fonds renouvelable finance certaines activités à même les revenus qu'elles générent plutôt que par les sources fiscales usuelles. La formule est séduisante mais ne peut s'appliquer avec profit qu'á certaines conditions. Une grille d'analyse en douze points permet de juger de 1'opportunité d'implanter un Fonds renouvelable.Abstract:Can the management methods of the private sector be applied to the public sector? Certainly not as a whole, because a major obstacle is created by the budgetary system of governments. Indeed, this system prevents an administrator from linking the costs of an activity to some form of revenues which would be related to it and from controlling expenses accordingly. The renewable fund formula is an exception. While remaining part of die governmental budgetary framework, the renewable funds finance some activities from the very revenues they generate rather than through the usual fiscal sources. The formula is attractive but can only be applied sucessfully on certain conditions. A twelve‐point analysis grid shows whether it is appropriate to set up a renewable fund.Combien de fois a‐t‐on entendu des cadres du secteur privé reprocher à leurs collégues du secteur public leur manque de rigueur financeére? Abstract:Two decades ago, the New Brunswick government began implementing the Equal Opportunity program, a sweeping reform of provincial‐municipal relations. It abolished the elected county governments, centralized some important functions at the provincial level, and instituted equalization in municipal financing.Here it is argued that the EO program had redistributive aspects which were crucial in selling it politically. The drive toward efficiency, however, was more fundamental. Centralized, uniform administration was to produce static gains and also dynamic ones, as obstacles to economic growth were eliminated. Finally, the provincial government's capacity to plan and accelerate development was enhanced, so EO had great political implications. Not only did it increase the stakes of political participation at the centre, but it also promised citizens more control over policy than had existed when neither level of government could act decisively.This internal reform had exogenous causes. New economic challenges were sensed in New Brunswick as in other provinces which essayed structural reform in order to manage them. Particularly important in New Brunswick were federal government initiatives framed as shared‐cost programs, which demanded a coherent provincial response. But it took brave leadership to push reform so far, so creatively.SommaireII y a deux décennies, le gouvernement du Nouveau‐Brunswick a commence à mettré en oeuvre le programme d'accés à l'égalité, une réforme radicale des relations provinciales‐municipales. II a aboli les gouvernements de comtés élus, a centralisé plusieurs fonctions importantes au niveau provincial, et a établi la péréquation dans le financement municipal.On soutient que le programme d'accés à l'égalité comportait des aspects redistributifs dont l'importance fut cruciale dans sa vente politique. Toutefois, le désir d'efficience a été plus fondamental. L'administration centralisée et uniforme du programme allait produire des gains statiques et dynamiques, à mesure qu'on éliminait des obstacles à la croissance économique. Enfin, comme on a accru la capacityé du gouvernement provincial de planifier et d'accélérer le développement, le programme d'accés a l'égalité a eu de grandes implications politiques. Non seulement a‐t‐il augmenté les enjeux de la participation politique au niveau provincial, mais il a également promis aux citoyens plus de contrôle sur la formulation de la politique qu'il n'en existait lors‐qu'aucun niveau de gouvernement ne pouvait agir de facon décisive.Cette réforme interne a eu des causes exogénes. De nouveaux défis économiques se sont fait sentir au Nouveau‐brunswick, comme dans d'autres provinces et on a essayé de les gérer par une réforme structurelle. Les initiatives du gouvernement fédéral sous la forme de programmes à frais partagés, exigeant une réponse provincial cohérente, ont été particuliérement importantes au Nouveau‐Brunswick.
