AbstractIn the Supreme Court's Eighth Amendment jurisprudence, “community sentiment” plays a central if not dispositive role in determining if a punishment is disproportionate. To gauge sentiment on the death penalty for juveniles, two experiments with death‐qualified subjects were run, whereage(a 15–25 age range) andcase(heinousness) were varied in the first, andtype of defendant(principal, accessory, or felony‐murder accessory) and anextended agerange (13–25) varied in the second. Significantageeffects occur in both experiments, with approximately 75% and 65% refusing to give the death penalty for the youngest (13–15) and next youngest (16–18) groups, whereas 60% give the death penalty for the 25‐year‐old. In their reasons for their decisions, the killing kid was judged less blameworthy and death‐worthy. Although politicians have called for “a man‐sized punishment for a man‐sized crime,” this community does not see that “man‐

AbstractChildren now experience war as they never have in the past. This article presents clinical impressions of children from war zones and suggests interventions that might ameliorate the horrors of war for some of these children. It also describes the evolving framework in international law (i.e., the United Nations) that provides a context for implementing some of these interventions and for insulating children from some of the devastating effects of war.

AbstractResearch and policy‐makers have frequently called for operational definitions of child abuse, however neither group has considered including children's perceptions of what constitutes abuse. The purpose of this study was to expand the discussion on definitions of child abuse by examining children's perceptions of physical abuse. This was done by collecting data to begin to document abused children's ratings of the seriousness of various abusive acts and to begin to examine gender and age differences in children's perceptions. The data revealed significant differences in children's perceptions of the seriousness of specific acts of abuse and a significant interaction between age and type of abuse. Although young children generally produced lower seriousness ratings than older children, their ratings were significantly lower on only a few types of abuse. When children's ratings were compared to similar ratings reported in earlier studies of adolescents, community members, and mental health professionals, the children in this study rated the abusive acts as less serious than the adolescents or community members, but very similar to the professionals who work in the area of child abuse and neglect. AbstractThis article focuses on the interests of the persons involved in the child abuse and neglect reporting process—(1) the child, the accused, and the family members of the child and of the accused; (2) physicians, psychologists, therapists, private agency and hospital social workers, educators, and other professionals; (3) law enforcement officers, state social service workers, lawyers, and judges; and (4) legislators. With this focus, the article illuminates the rationales and explicit and implicit policy choices reflected in the legislation's reporting requirements and processes. Such insight is necessary to a critical review of existing legislation and future improvements in the practical operation of reporting law legislation. This article demonstrates that the interaction of these interests is complex and often creates competing concerns and goals. AbstractThis article first briefly discusses the problem of delayed memories and long‐term effects of child sexual abuse and the current trend to bring civil lawsuits or criminal prosecutions for childhood sexual abuse. The article addresses the primary obstacle to such actions—the statute of limitations—which in most states places a time limit on when legal actions can be commenced. It describes the purpose of the statute of limitations and the need for changing or extending it in child sexual abuse cases; it then summarizes and analyzes the methods used by state legislation and judicial decisions to change or extend the statute of limitations in both criminal and civil actions. AbstractThis Research Report presents an initial attempt to apply the theory of counterfactual thinking to study the cognitive processes that underlie judgments of negligence. Subjects reviewed a summary of an appellate case involving a work accident and listed all the ways in which the accident could have been undone (mutated). Participants' evaluations of the defendant's behavior were influenced by the ease of mutation of the negligent act and other mutations of the defendant's behavior, but not by the number of mutations of the plaintiffs conduct. Exploratory path analysis suggested that counterfactual thinking may have its greatest impact not as a direct influence on verdicts and damages, but rather as an indirect influence impacting verdicts through lower level judgments about the normality of the defendant's behavior and the standard of care. The results also suggest that contrary to the law, subjects base their negligence verdicts on assessments of normal care along with due care.
